It is the goal of Lead Public Agencies and U.S. Communities to provide world class government procurement resources to all eligible public agencies. Lead Public Agencies have become aware that certain states may prohibit public agencies from entering into any agreement that contains hold harmless or indemnification provisions. In an effort to resolve this potential limitation for certain public agencies, Lead Public Agencies have worked together and updated the MICPA (Section 7) to accommodate those states that may have hold harmless or indemnification restrictions. All updated MICPAs have been executed by the Lead Public Agencies with the exception of Washington County Public Schools and the City of San Antonio. These existing MICPAs remain in effect and are available with all other Lead Public Agency certificates.
